This agreement is between you (“you”, “your”, or “User”) and Moneda Digital GmbH (“Moneda”, “us”, “we”, “our”, or the “Company”). These Terms of Service ("Terms") govern your use of the Moneda app and its associated services (collectively, the "Service"). By accessing or using the Service, clicking a button or checkbox to accept these Terms (eg. “I agree”, “Get started”), or otherwise agreeing to these Terms electronically or in writing, you agree that you have carefully read and accepted all of the below Terms. If you disagree, you may not use the Service.

1. Overview

Moneda provides a non-custodial wallet interface for managing stablecoins and accessing third-party decentralised finance (”DeFi”) protocols for yield generation. The Service includes access to an interface for managing digital assets such as USD and EUR stablecoins (collectively “Assets”) and an Earnings Account powered by third-party services, such as the Morpho protocol, for yield generation.

Moneda does not provide custodial services. Moneda does not directly or indirectly manage, control, or hold user assets, nor does it facilitate interaction with third-party custodial services. All accounts and transactions are fully self-custodial, meaning users retain full control and responsibility over their assets and credentials.

NOTICE TO PARENTS AND GUARDIANS: By granting your minor permission to access the Service, you agree to these Terms on behalf of your minor. You are responsible for supervising your minor’s online activities. If you disagree with these Terms, do not let your minor use the Service.

3. About the Services

  1. The Services facilitates access to third party services to enable users to manage their crypto asset treasury effectively and efficiently. The Services further provide a non-custodial key management solution leveraging passkey technology that supports your ability to securely decrypt and sign data using proprietary API technology.
  2. To access certain features of the Services, you will need to create a Moneda account. You shall provide Moneda and its service providers with accurate, complete and current account information and keep this information up to date. You are responsible for all activities that occur under your account.
  3. You may participate in the Services by creating a single or multiple digital wallets (collectively “Wallets”), which allows you to acquire, store, and engage in transactions using supported digital assets. Moneda does not have access and does not control any User Wallet.
  4. The USD and EUR Accounts in the Moneda app represent balances of USDC and EURC, which are electronic money tokens (“EMTs”) issued in accordance with the Markets in Crypto-Assets Regulation (MiCA) in the European Union. These digital assets are denominated in fiat currency and fully backed by reserves, but they are not fiat bank accounts and are not covered by any deposit guarantee scheme under EU or national law.
  5. Moneda does not act as a bank, broker, financial institution, credit institution, electronic money institution (EMI), or Crypto Asset Service Provider (CASP) and does not issue, redeem, or hold custody of the EMTs on behalf of users. Instead, the Services provide non-custodial access and smart contract-based Software as a Service (SaaS) infrastructure that enables users to interact with these digital assets in a self-custodial manner.
  6. Transactions are conducted on blockchain networks (collectively ”Networks”). The Company does not buy, sell, or take custody or possession of any digital assets, nor does it act as an agent or custodian for any user of the Services. If you elect to buy any digital asset, any transactions that you engage in will be conducted solely through the blockchain network governing the digital asset. You will be required to make or receive payments exclusively through the Wallets that you have connected to the Services. The Company has no insight into or control over these payments, nor do we has the ability to reverse any payments or transactions. Accordingly, the Company no liability to you or to any third party for any claims or damages that may arise as a result of any transactions that you engage in via the Services.
